Zweck der Verarbeitung

Bei Nutzung der AI-Fotobooth wird ein Foto von Ihnen aufgenommen und mithilfe künstlicher Intelligenz (KI) in ein individuell gestaltetes Bild umgewandelt. Die Verarbeitung erfolgt ausschließlich zur Erstellung des von Ihnen ausgewählten Fotomotivs sowie zur Bereitstellung des Ergebnisses über einen persönlichen QR-Code.

Die Nutzung der Fotobooth ist freiwillig.

Welche Daten werden verarbeitet?

Im Rahmen der Nutzung der AI-Fotobooth werden folgende Daten verarbeitet:

  • Das von Ihnen aufgenommene Foto
  • Das daraus generierte KI-Bild
  • Technische Daten, die für die Bereitstellung des Download-Links erforderlich sind, zum Beispiel Session-ID oder Download-Token

Es werden keine Namen, E-Mail-Adressen, Telefonnummern oder sonstigen Kontaktdaten erhoben.

Rechtsgrundlage

Die Verarbeitung Ihrer Daten erfolgt auf Grundlage Ihrer freiwilligen Einwilligung gemäß Art. 6 Abs. 1 lit. a DSGVO.

Mit der Nutzung der Fotobooth und dem Auslösen des Fotos erklären Sie sich mit der beschriebenen Verarbeitung Ihrer Bilddaten einverstanden.

KI-Verarbeitung

Für die Erstellung der Bildmotive wird die KI-Technologie Google Nano Banana (Pro/2) eingesetzt.

Die Verarbeitung erfolgt automatisiert auf Grundlage Ihres aufgenommenen Fotos.

Die von Ihnen aufgenommenen oder generierten Bilder werden nicht zum Training, zur Verbesserung oder Weiterentwicklung von KI-Modellen verwendet.

Ort der Verarbeitung

Die Bildverarbeitung und Datenspeicherung erfolgen auf Servern in Deutschland.

Der eingesetzte KI-Anbieter, Google Nano Banana (Pro/2), gehört zu Google LLC mit Sitz in den Vereinigten Staaten von Amerika. Die Verarbeitung der Bilddaten erfolgt jedoch ausschließlich im Rahmen der Bereitstellung der AI-Fotobooth und unter Einhaltung der geltenden Datenschutzvorschriften.

Empfänger der Daten

Die Bilddaten werden ausschließlich zum Zweck der Bereitstellung der AI-Fotobooth und der Erstellung Ihres KI-generierten Bildes verarbeitet.

Eine Nutzung der Bilder für Werbe-, Marketing- oder Trainingszwecke erfolgt nicht.

Eine Weitergabe an sonstige Dritte erfolgt nicht, soweit dies nicht technisch für den Betrieb der Lösung erforderlich ist.

Download der Bilder

Nach der Erstellung Ihres Bildes erhalten Sie einen individuellen QR-Code.

Über diesen QR-Code können Sie Ihr persönliches Bild herunterladen. Der Download-Link dient ausschließlich dem Abruf Ihres Bildes und enthält keine persönlichen Angaben zu Ihrer Person.

Bitte behandeln Sie den QR-Code vertraulich und teilen Sie ihn nur mit Personen, denen Sie Zugriff auf Ihr Bild gewähren möchten.

Speicherdauer

Die aufgenommenen Fotos und die daraus erzeugten KI-Bilder werden für einen Zeitraum von maximal sieben (7) Tagen gespeichert.

Nach Ablauf dieser Frist werden sämtliche Bilder automatisch und dauerhaft gelöscht.

Ihre Rechte

Sie haben nach den geltenden Datenschutzbestimmungen insbesondere folgende Rechte:

  • Recht auf Auskunft über die zu Ihrer Person gespeicherten Daten
  • Recht auf Berichtigung unrichtiger Daten
  • Recht auf Löschung Ihrer Daten
  • Recht auf Einschränkung der Verarbeitung
  • Recht auf Widerruf Ihrer Einwilligung mit Wirkung für die Zukunft
  • Recht auf Beschwerde bei einer zuständigen Datenschutzaufsichtsbehörde

Freiwilligkeit

Die Nutzung der AI-Fotobooth ist freiwillig. Ihnen entstehen keine Nachteile, wenn Sie die Fotobooth nicht nutzen.

Purpose of Processing

When using the AI Photobooth, a photograph of you will be captured and transformed into a customised image using artificial intelligence (AI). The processing is carried out solely for the purpose of generating the selected image and making it available to you via a personal QR code.

Participation is entirely voluntary.

What Data Is Processed?

The following data is processed when using the AI Photobooth:

  • The photograph taken of you
  • The AI-generated image created from that photograph
  • Technical data required to provide the download link, for example a session ID or download token

No names, email addresses, phone numbers or other contact details are collected.

Legal Basis

The processing of your data is based on your voluntary consent in accordance with Article 6(1)(a) GDPR.

By using the AI Photobooth and triggering the image capture, you consent to the processing described in this notice.

AI Processing

The image generation is carried out using Google Nano Banana (Pro/2) AI technology.

The processing is performed automatically based on the photograph taken within the Photobooth.

Neither the original photographs nor the AI-generated images are used to train, improve or develop AI models.

Location of Processing

Image processing and data storage are performed on servers located in Germany.

The AI provider, Google Nano Banana (Pro/2), is operated by Google LLC, headquartered in the United States. Any processing takes place solely for providing the AI Photobooth service and in compliance with applicable data protection laws.

Recipients of the Data

The image data is processed exclusively for the operation of the AI Photobooth and the generation of your AI-created image.

The images are not used for advertising, marketing, profiling or AI training purposes.

No disclosure to other third parties takes place unless technically required to provide the service.

Downloading Your Image

After the image has been generated, you will receive an individual QR code.

Using this QR code, you can access and download your personal image. The download link contains no personal identification data and is solely intended to provide access to your image.

Please keep the QR code confidential and only share it with individuals to whom you wish to grant access.

Data Retention

The original photographs and AI-generated images are retained for a maximum period of seven (7) days.

After this period, all images are automatically and permanently deleted.

Your Rights

Under applicable data protection laws, you have the following rights:

  • Right of access
  • Right to rectification
  • Right to erasure
  • Right to restriction of processing
  • Right to withdraw consent at any time with future effect
  • Right to lodge a complaint with a competent supervisory authority

Voluntary Participation

Use of the AI Photobooth is entirely voluntary. You will not suffer any disadvantage if you choose not to participate.
